Hi everyone. I am currently in receipt of DLA, both components at high rate. I suffer with various health conditions some of which are both rare and complicated. Having spent years being hawked around loads of hospitals and undergoing numerous tests and scans both as an outpatient and an inpatient, I was told that there is no possible cure for the conditions, even surgical intervention would only be considered if things became life threatening as the outcome of the surgery could be catastrophic in the sense that I would need to be tube fed for the rest of my life. So I have been left to cope on my own. I have no contact with hospital consultants and only see my GP when my prescription is due for review which is approximately once a year. I have to take slow release morphine sulphate twice a day and oramorph throughout the day & night for breakthrough pain. The 2 GPs that have known me all of my life and know about my health conditions and how they effect my day to day life have both retired. the only evidence I have to prove my conditions are scan reports and letters from consultants I have seen over the years, they are all dated pre 2008. I enclosed these with my ESA form when I transferred from incapacity benefit to ESA and was placed in the support group for 3 years without a face to face.
I understand that PIP is a totally different benefit and much harder to claim. I am worried that being "parked" will make it impossible for me to qualify for PIP and I will lose the money entirely. My husband works part time so he can care for me so losing the money would make our financial situation dire. So, my question is, In your opinion is there anything I can do to increase my chances of a successful outcome.
Any advice will be much appreciated.

Whilst PIP and ESA are different benefits, the fact that you were successfully placed in the ESA Support Group with the evidence that you have available is a positive thing as it shows that both the assessor and the DWP Decision Maker agreed that it indicated a significant level of problem with your daily activities.

Evidence of a diagnosed condition is important, but it will be your detailing your problems for Daily Living and Mobility which will ultimately score you points, so whilst your not having up to date evidence certainly will not help, it may not be the problem that you think it is.

Some things for you to think about.

PIP, in many areas has stricter criteria then DLA, but there are more opportunities to score points for PIP than there are for DLA, not that DLA was points based.

The walking test is much harder as the distance is reduced to 20m from 50m but this may be offset by the fact that you can score points from both the Going Out and Moving Around Descriptor whereas these were separate under DLA.

The major issue for your HRC award is that PIP looks at the severity of the claimants problems rather than their duration as DLA does. So whilst someone with moderate problems both day and night could get an HRC award for DLA they may only score sufficient points for a Standard award under PIP, whereas someone with severe problems during the day or night, but not both would not have qualified for HRC but might now receive an Enhanced award under PIP.

The last thing to consider are your use, if any, of aids and appliances, under DLA this would have counted against you, with PIP you may actually score extra points for this.

Thank you so much Gordon for your prompt and in depth reply. I feel better knowing that my old evidence may be considered. I am in the one of the postcode areas that have been brought forward from October to July so I will now start to study your guides and practice answering the questions.
I feel reassured that I can contact you again for advice along the way.

my dla award runs out in September was contacted about transfer to pip in april had ny assessment in june got my decision end of june awarded enhanced rate of mobility and standard rate care. now got a esa assessment coming up at end of july. was in support group before for esa. heres hoping everything turns out well.
