given 18 points but refused pip was created by nana neesie
hi bro i,m writing concerning my sister in law she fell last august breaking her hip she is 58 she was in hospital weeks operated on ect she put in for pip and recieved 8 for daily living and 10 for mobility up to now a year on she still has not recieved anything she has rung up and they say they are waiting for the year to be up to see if she is any better?. she rang friday 7th august a year to the day of the accident and was told to appeal as she is out of time ?? the dwp on the other end also said tell them its our fault???? or for her to make a new claim any advice i will pass on i have told her to appeal as she has 18 points recieved in october 14 and is entitled , should i tell her to go to cab as i cannot sort hers as well as my partners out thanks in advance

I am not really clear on what you are saying ???

If you are stating that she received Standard Rate Daily Living (DL) & Enhanced Mobility PIP Awards a year ago but never received any payments of PIP, this is obviously a DWP Administration error.

If she has the PIP Decision Notice letter informing of this decision in writing, she should send copy of that to The DWP querying why she has not received any payments :

Sending Documents to the DWP, ATOS, Capita or Maximus.

She could also contact her M.P. :

Contacting your MP

If this decision has been made, it is not adverse, therefore there would be no need to request an MR or Appeal it.

Either there is an award or there isn't, if there is then the DWP cannot withhold hold payment in case she gets better, if they have concerns about this then they should re-assess her.

The PIP criteria includes a forward requirement of nine months, so by definition any award assumes that the claimant will not get better for at least this period.

when she rang dwp friday they said appeal or make a new claim i have told her to do niether till i contact you i have seen the letter and it gives the points and that is all she has recieved the first time she rang dec 14 they said they did not know what has happened and the times since then every couple of months they have said the same till next friday what does timed out mean ??

Hi nn,

One can only assume that the term "timed out" is being used with respect to the absolute time limit to request a "late" MR or a "late" Appeal, which is 13 months from the date of the adverse Decision Notice letter.

If there has been a PIP Award, and she has the PIP Decision Notice letter, and was happy with the award, what is there to appeal ?

If the DWP have errantly failed to instigate her PIP payments, that is not an adverse decision, it is an administration error.

If she is sure that she received a PIP Award, I would be on to her M.P. ASAP.

It sounds like she has been given the "runaround" !!!

She could also contact The CAB or the like !!
