Hi all and I hope I find you all as well as can be!

I am about to submit a pip MR on behalf of my wife, she was receiving DLA HRM and HRC for several conditions but was called to apply for pip, to cut a long story short she was awarded 8 points for pip care (standard rate care) but only 4 points for mobility ( 0 points for Q11 Planning and following Journey and 4 for Q12)

Basicly she has several back/walking conditions for which she has always been awarded HRM for DLA and exchanged her allowance for a motability car (which now has to be returned in 3 weeks)

All her points where awarded for her mobility conditions and her several mental health conditions have been ignored (I have plenty of evidence from her psychiatrist and GP to send in for the MR)

Sorry after all that ive not even asked my question so here goes

Before my wife had mobility problems she was awarded DLA for her mental health HRC but LRM (as they took mental health into account)

As she was awarded 0 points for planning and following journey this will be our main challenging point for the MR, We have 2 letters that her psych and GP have written in last 2 days and I would like to post the content of said letter now to see if the forum thinks it will be helpful

To Whom it may Concern

My patient Bla Bla

suffers from several serious and enduring mental health conditions one of those being severe and intrusive OCD and as a result of this is unable to use public transport (not through choice but as a result of her condition). She also cannot follow an unfamiliar journey unaccompanied due to excessive checking leading to her becoming lost and said journey would take an excessive amount of time, she becomes very anxious doing most unfamiliar tasks. Please take this into consideration in assessing her case.

Some comments for you.

The letter attempts to address the requirements of the PIP Descriptors which is good.

I would gave a look at the latest PIP Claim guide for the Going Out activity, in particular how the DWP view this activity and their view of "prompting" versus attention.

We have also recently seen several claims refused in regard to the use of public transport for this activity. DWP guidance suggests that the use of this is relevant, however, the definition in the legislation makes no reference to this, so I would be careful of relying on this. If you can find other ways to justify the points then I would include them.

Although the doctor has offered to provide additional information, I would not rely on the Assessment Provider or the DWP contacting them for this, if they are prepared to provide additional evidence then it is better that they do it now.

Just a quick question to clarify something

If i have requested the MR within the 1 month deadline but send in further evidence and the actual reasoning for the MR a week after the deadline will this be accepted by DWP? Am i thinking right that the deadline is just to let them know we wanted a MR and that further info is acceptable after this 1 month date so long as its with the Decision Maker b4 he looks again at it
