Hello ...just received esa 50 to fill out for my son in his 20's
My son has been to see psychiatrist and they feel he has schizoid /schizotypal pd and autistic traits ..It has taken many years to get this far as he did not want me to contact any dr's. He hardly said 2 words in the dr's and it was me doing all the talking .
My son has never worked and never claimed any benefits and we support him fully and wholly in every aspect of his life .He does not go out at all except to walk the puppy we bought him to encourage him .He has not washed or cut his hair or shaved his beard in years .When I said we need to get him help as he will end up homeless when we are not here ,he said "yes I know " heartbreaking
So really what I want to know ...will maximus accept me talking for my son ( he absolutely does not want to be there! ) and me explaining his difficulties. He needs to go in support group as he will not go to any work related interviews if asked.

Hello, firstly may I say well done in supporting your son . I realise such things cant be easy some days.

Just to confirm, you are allowed to fill out the ESA50 on his behalf as long as it represents his words thoughts and actions.

In terms of attending interviews, to the best of my knowledge, the claimant (your son) has to attend personally. You may go as a supporter.
Maximus/DWP do have the ability to arrange home visits for the medical assessment.

You never mentioned whether he is making a claim for PIP? Personal Independence Payment. Which is a payment for those with long term needs due to a medical condition.

We had/have (but much improved so there is hope ours is now 25) the same situation, with the help of his GP, mental health team and a private therapist letters etc and much demanding and bullying on the phone by me, no assessment was required because the stress, expectation of attending a face to face when someone cannot reliably and safely leave the house, is a breach of the rules.

It would serve no useful purpose unless they are to find a properly qualified assessor and this should be a home visit. He is classed as very vulnerable at risk of self harm (he is doing it already by not washing etc.

You need to get letters from all concerned, notify the centre regarding a home visit and explain about the letters being sent direct to them from the health professionals involved. Ask for copies for your file.

If this made your sons condition worse they would be liable and given the publicity currently surrounding the appalling treatment of young people with mental health issues, they will comply.

Our son was placed in the support group, were he remains today. He was due a reassessment but we have not heard anything.

Good luck, although in cases like this luck does not apply, fight, be adamant, get letters everything from anyone you can including yourself.

We were not successful with PIP apart from lower rate mobility, really should have challenged that too but we were just glad to have him in the system.

Thank you both for replying ....It is difficult as my son does not want therapy or any help at all ...he has refused it ..he has been under the care of GosH since a baby regarding another illness and it was the specialist I blurted it out to in one check up as I was desperate.The psychiatrist report says he is vulnerable and a high risk to self if it were not for us.
He has not gone to the dentist or optician for years etc etc etc I could go on :(

We have not tried PIP yet but that is next .
I am going to go with him to assessment regardless where it is as he wouldn't go otherwise .I just read on one forum that a mum was told to be quiet as the Dwp wanted the son to answer but my son will be extremely anxious and will give one word answer !

The primary issues with you speaking on behalf of your son at an assessment are;

Are you your son's appointee? The DWP can appoint someone to act on behalf of a claimant if they deem that they are not able to manage their own claim. If you are then you should be allowed to speak.

Is he aware of his problems and the degree to which he is effected and if this is the case is this documented in the medical evidence that you have sent in? If he is not full aware of his condition then it would be reasonable for you to speak on his behalf.

If none of the above apply then the assessor will expect your son to be the primary source of information during the interview.

If the assessor asks you to remain silent during the assessment then you will need to be careful about talking on your son's behalf, the assessor can curtail the assessment and class you and your son as failing to participate, at the very least this may require a new appointment and at worst it could mean his file being returned to the DWP. So you need to be careful.

Gosh this is going to be difficult isn't it?
....If left to himself he would not apply for anything he says he doesn't want/need money ..It is documented that he says this is just how my brain works and he just does not care and that's his life full stop ..its like he has accepted he has no life to live ....he does not like even talking about it all to me.
His physical appearance straight away tells you something is wrong... his hair is matted ..he looks like a vagrant so so upsetting .
Do I just ask to be his appointee to Dwp? I am for my other son for dla and we had a lady come to the house and question me but that was easy as my son is in resi special school .
