CB WRAG Appealing for support group. Confused!

Hi
Am appealing being in WRAG, for Support Gp. My ESA WRAG (CB) stopped a year ago under the 365 day ruling. Have waited a year for the Appeal! I have been told that I will only be entitled to about £5 if I win. Am very confused by this-has the law changed yet again? I don't get any other benefits.

Hi K,

Did you appeal the WRAG decision within the one month deadline from the date of the WRAG Decision Notice letter, and have been waiting for your appeal to be heard since then ?

If so, and your appeal is successful and you are placed into The SG, as the Tribunal's decision would be a remaking of the original WRAG award that you appealed, you would be classed as having been in The SG since that date, and would therefore be entitled to any back payment of arrears from that date.

It would be as if you had never been in The WRAG. As you know there is no 365 day limit to payment of CB ESA whilst you remain in The SG :

12 Month Limit for ESA(CB)

i am under the impression that once you have been on esa for 1 year, and providing you dont have any assets then you are transferred to esa ir, as long as you have paid adequate ni contributions

Just to add to Bro58's post, based on your post, if you were put in the Support Group, you would receive back payments of approximately £5 for the first 365 days, that being the difference between the WRAG rate and that for the Support Group, and then the full Support Group rate from day 366 until the date of your appeal and then on-going SG payments.

Many thanks Guys. You have given me hope! Am I right in thinking that after backpayments of £5 a week, I am then entitled to full rate ESA SG if I win the Appeal? (The Tribunal is tomorrow).
