Just received another ESA 50 was created by ibroxbear1873
Having just received another esa50 form i was wondering which documents i should ask for from the benefits office where my last decision was made? As i never attended a medical and the Atos decision was overturned by a DM.

Can i also ask which category (as in where i scored the 15 points needed) to put me into the Support Group the last time?

And finally i was told last time verbally but not confirmed in writing that my award was for 1 year and am now only at 9 months should i query this?

Thanks

Hi BT,

As you did not have a face to face it would be an ESA85A Medical Report.

You should take into account, that as the ESA85A seems to have recommended an assessment of (LCW) WRAG that the DM may have applied a different prognosis, and has also obviously applied at least one of the SG Descriptors at reconsideration.

This information regarding the reconsideration may be in The LT54.

(There will definitely be an LT54 as well as an ESA85A)

You could stipulate that you are requesting written confirmation of which SG (LCWRA, Schedule 3) Descriptor/s was applied to you.

Even though some of the WRAG Descriptors that score 15 points are the same as the corresponding SG Descriptors, the SG Descriptors are not actually points based.

The recommended length of any ESA award (The prognosis) is just that, a recommendation. It would not be unusual to receive a new ESA50 two to three months before a current prognosis was coming to an end. This is to allow for the 4 weeks to fill in and return the ESA50, a face to face if one is deemed necessary and other admin involved with the reassessment.

As you are pushed for time, you could request the ESA85A etc over the phone, and back this up in writing. However, you may not receive it by the deadline date for return of The ESA50.

Hi BT,

Don't miss your ESA50 deadline return date if you haven't received them.

The important issue is to fill in the ESA50 as best you can, whilst referring to our guides.

Please keep us updated.

Finally after 3 months of waiting I got a decision! SG and no medical! :cheer:

Some more questions now though....

Was thinking to ask for a copy of the following ESA113, ESA85A, ESA72 and LT54 would that be the correct information to request and would that forms include the details of which descriptors were applied to me for the SG placement? Also mindful that after such a good result I should maybe not rock the boat so to speak?

If I were to apply for PIP on my medical conditions that I feel would be relevant and be refused can that have any effect on my ESA award?

Congratulations on the award

Yes, those are the forms to ask for, although there is unlikely to be an LT54 as these are only used for Reconsiderations and Supersessions, but who knows :)

The water is untested in regard to PIP affecting an ESA award, but I think it unlikely that there will be an issue as there are limited areas of overlap in he criteria, even in the Mobility area the criteria are still different enough (PIP to ESA), that it should not be a problem.
