Esa letter to gp was created by Paul
Hi , my wife lost her tribunal appeal to be migrated to the support group last Tuesday.
She has received a letter from her gp surgery , stating that they had received a letter
From ESA , and my wife was to see her GP so that this letter "could be completed".
My wife suffers anxiety , depression , is agoraphobic and has injuries to her knee
and shoulder , which have not been seen by a GP , as my wife cannot bring
Herself to visit the surgery ( a number of bad experiences with the medical "profession").

Just wonder why the surgery is pushing her to see them , and is there a risk to my wife's
Benefit if she just ignores the letter.

My wife receives contribution-based ESA , but has not been to any WFI's.
Thanks.

Hi F,

I am sorry to hear that your wife's appeal failed. :(

As it appears that your wife is in receipt of CB ESA in The WRAG, and has been since circa December 2012, are you aware of this :

12 Month Limit for ESA(CB)

Previous posts, here :

www.benefitsandwork.co.uk/forum?view=top...d=10&id=97931#103929

As I see that your wife has had to fill in another ESA50 since her last WRAG award, this "letter" that your G.P. surgery is referring to may well be in connection with that reassessment, and may in fact be an :

ESA 113 Questionnaire

You need to clarify this with your G.P. practice.

If it is as above, and pertaining to her ESA reassessment, it may well be in her best interests to attend.

She will then have some input into what the G.P. writes on the ESA113 which will then be returned to The DWP/ATOS and used as evidence in her reassessment.

The fact that the practice has contacted you is a positive, as many G.P.'s simply fill these in and return them without the patient knowing.

There is a possibility that your wife could be placed into The SG at this reassessment. If that happens the SG award will supercede the WRAG award confirmed by The Tribunal.

Hi F,

If your wife is agoraphobic, you could request a home visit or telephone consultation from her G.P., to discuss this issue.

Hi F,

Just to add,

It is not the norm for The DWP/ATOS to send ESA113's to a claimant's G.P.

See this extract :

"We ask you to complete this form if we think that the patient may have a severe health condition or disability but do not have enough information to be sure."

From page 6 of this document :

G.P.’s Completing Medical Reports for DWP

Therefore, DWP/ATOS "may" be considering whether or not your wife does qualify for The SG, but require more evidence.

Hi , and thanks for your replies.
To be honest my wife has such a distrust of the medical profession that she is prepared to give up her benefit entitlement , rather than face more "confrontations".
The last atos assessment was hell , and resulted in my friend , who went with her , being asked to leave after he got annoyed at the hcp's aggressive and unsympathetic manner.
The hcp , without a witness , proceeded to shout at my wife , calling her a liar , and threatening to have her parental ability investigated unless she agreed that , yes , she did indeed do housework , cook , clean and dress her children(aged 14 and 16).
This assessment was covertly recorded by my friend (my nervous and physical state prevented me from being with her) up to the point when the HCP screamed at him and ordered him to leave the room.
All true, and an incredible show of unethical and unprofessional conduct.
Thanks.

Hi F,

Sorry to hear of your wife's treatment by The ATOS HCP.

There is a possibility, that your wife may not have to attend a face to face assessment with ATOS, if enough paper evidence, such as the ESA113 is provided.

It is up to you and your wife on what course of action to take, however it may be worth telephoning your G.P. to discuss this further, and then making a decision if or when you receive a letter from ATOS.
