transfer from sda to esa was created by intrested
hello
please help me i have had letter stating i will now be contacted in two weeks to be assesed for esa .i am confussed i thought people on sda were not getting assesed yet plus i am in reciept an indefinate award of higher rate care and mobility realy stressed please help.

Hi i,

All recipients of IB, IS or SDA are being transferred over to ESA. This has been going on since March 2011, and due to be completed by Spring 2014.

They did state that SDA recipients would be transferred over last in the migration process. We have had one other member who is in receipt of SDA and has started the process a couple of weeks ago.

Some of the recipients above may have been PCA Exempt due to being in receipt of HR Care Component DLA, or for other reasons.

There are no such exemptions with ESA, and all of the above will have to be assessed under The ESA Work Capability Assessment. (WCA)

Have a read through this document :

"Being transferred from incapacity benefit to employment and support allowance. A 22 page guide to the transfer process."

At the top of this page :

ESA Claims Guides

As you have received the conversion notice letter, you should now receive a courtesy phone call, (which you don't have to take) then within a fortnight or so of the letter you should receive the ESA50 Questionnaire.

Therefore you could start filling in the ESA50 Questionnaire now, by :

Using The PDF Version Of The ESA50 Questionnaire

Whilst referring to the ESA Claims Guides under the heading :

"New ESA50 form"

On the same ESA Claims Guides page as above.

It has to be filled in and returned it to ATOS by the deadline that you will be given when you receive the hard copy ESA50 through the post.

The PCA or Personal Capability Assessment was the medical for IB claimants, some claimants were exempted from attending, however, this rule does not apply to ESA, so do not worry about it as it is not relevant.

Thank you sorry again can I reqest a docter medical as a lot of my poblms are of a personel nature and are rooted to traumatic happenis when younger and it is gping to be difficult as it is sorry to be a bother

Hi i,

You could request a Doctor in the ESA50. However according to information given out by ATOS, they only provide Doctors for certain complex neurological conditions.

If your limitations are caused by Mental Health issues, ATOS do state that they have Mental Function Champions, who the assessing ATOS HCP is supposed to have telephone access to, where needed.

Whether they actual apply this, is a different matter.

It may help if you actually request that an HCP with some expertise in Mental Health issues is used for your assessment, as there has been recent case law where a Physiotherapist was used to assess a claimant with MH issues, found them fit for work, and the Upper Tribunal Judge deemed that the Physiotherapist's opinions were not of any relevance, as they had no experience/training in MH issues.

It may help with an appeal if needed if you request an HCP with MH training beforehand, if they then fail to provide one, and find you fit for work.

Remember, if you can provide enough evidence in the ESA50 and any added documentation, there may be no need for a face to face assessment.
