Help on PIP please was created by Mandy
Hello,
I have been through Mandatory Reconsideration with a decision notice received in Jun. I filed for appeal within the one month deadline in early July. I received the acknowledgement of the appeal from the tribunal service.
Here's where I need help. Last week DWP called me and asked if they could look at the decision again. I said I didn't know as I thought next step was the appeal. They asked if I could send more evidence in. I said not sure as my representative wanted to see the appeal bundle first. I said I wasn't agreeing to anything. Then two days later I got a letter from DWP saying lies. It said I had asked them to look at the decision again (lie) and that I said I would send more evidence (lie). It has a deadline of 15 Aug to send in the medical evidence or they will make a decision with what they have. What does this letter mean? They already did their final decision! Did they stop the appeal? Will I have to file for appeal a second time after this post-MR decision? I have not heard of this before and am very confused and worried. Many thanks.

The DWP are entitled to look at your claim again if they wish but the cannot require you to participate in the process unless you wish to nor can their actions affect your appeal unless they make you a more advantageous offer and you accept it.
That said I would write a short letter and send it to the DWP office dealing with your claim and to the Tribunal Service, assuming that this is what you want, that you have not authorised the DWP to carry out any further of their Decision and that you wish to continue with the currently requested appeal.

Since they've given me zero points, any offer would be more advantageous. I will write the letter you suggested. Should it be sent by me or my representative?

A more advantageous Decision means exactly that but that does not mean that it will be the award that you think that you deserve.
The letter should come from you, but you might want to ask your advisor for assistance in drafting it.
