Dear Gordon,
My Wife lost her Motability scoring only 10 points on the getting around section some two years ago. She filled in the form at the getting around - Saying she is frightened to go out alone and suffers terrible panic attacks etc, but she did not score any points ?
Last week a letter arrived saying they had looked at her claim again, but the decision stays the same.
My Wife was born with Central Core muscle wasting disease which is a shoot off from Muscular Dystrophy so her health and walking will never improve, only get worse.
Is there anything we can do to challenge this latest refusal, we will be grateful of any advice.

This would appear to part of the review of 1.6m PIP claims due to the DWP's changes to the Going Out activity that were subsequently found to be illegal.
The Decision is in regard to your wife's conditions as they were when her current award was made, any changes since then will not be considered.
What did she score the 10 points for, the Moving Around activity, the Going Out one, or a combination of the two?

Gordon...What part did they say was illegal? This would be a massive help to us as , as you may remember?? we are going through the DWP grinder machine! still waiting for the MR and it's all down to the mobility section from full award to nothing.
We have more hope with the appeal where sensibility prevails but hope the MR proves successful.

I can't see how it would have affected you as the changes were reverted in the summer and your Decision post dates this.
