Can I ask what the legal position is if you record covertly on your phone? If a transcript is taken from it e.g. to prove the assessor was wrong would that be admissible as evidence if it came to it? Thanks
It is legal to covertly record an assessment but be aware, if the assessor finds out that you are doing this then they may terminate the interview and you will be classed as failing to participate.
There are a number of unresolved legal issues with the actual recording but a transcript should not be affected by these.
The DWP do not even review recordings made with their permission so I would not expect the transcript to be of any value in an MR. You can submit it as part of an appeal.
