Hi
I have been awarded PIP after two years of waiting for my tribunal but do the DWP have to pay my award? My understanding is that the tribunal has no legal powers to enforce its decisions on any party.

Whilst strictly this is true, I cannot remember a single occasion where it has happened, however, there are circumstances where an award would not be payable but this is a different thing.

The DWP have two choices;

- put the award into payment if it is payable, or
- appeal to the Upper Tribunal, however, they cannot do this just because they do not like the Decision, they must show that there has been an Error of Law in the making of the Decision.

It usually takes the DWP 5-8 weeks to process a Tribunal result, if you have not already done so, check that they have received the Decision Notice.
