PIP Appeal was created by Midnights mum
Was awarded PIP basic rate in 2017 for 2 years, review Aug 18 and PIP ceased Jan 19 following f2f.
Submitted very detailed MR request but declined as HP had failed to record key issues at F2F.
Am preparing an appeal using your member docs, HP refers to me as he ( I am female) on several occasions, records that I declined physical exam ( I did not) then lists long report of movements that I did not do. Should I use this information in Appeal?
MR also states that use of public transport/ anxiety re toilet access on public transport due to Crohns is not relevant, is that correct?
I will try to get slot with citizens advice but not easy in this area☹️
Many thanks

The Tribunal panel will make their Decision based on whether you meet the criteria for an award or not, I'm not saying to ignore the report, you shouldn't but you must make sure that you have explained why you meet the legally defined criteria first.

Whilst an inaccurate report is almost certain to have played a part you also need to consider whether you have properly explained your problems in your claim form, is it possible that you have misunderstood the Descriptors, described your problems in terms that do not match the Descriptors or failed to make appropriate use of the reliability criteria or the need for your limitations to be present on the majority of days to be considered?
