Hi Gordon or whoever is moderating,
I'm sure i've read somewhere, maybe even on a reply back to 1 of my questions in the past, that you can have longer than 30 days to submit an ESA MR. I've still not done mine yet as I'm still waiting on some supporting medical evidence to come through and I need to see the exact wording on the letter to know how to then go about my MR.
Anyway I rang the DWP today to say that my MR will not be in by the 30 days and the man on the phone was adament that it has to be in by then or it's to late to request an MR.
So can you you just shed a bit of light on whether he's right, or whether i'm right in thinking that I can have longer than the 30 days being as i've informed them of a delay in me returning it.

You have one month from the date of the Decision for the DWP to receive your MR request

You can make a Late request up to 13 months after the date of the Decision, you must give your reasons for the Late request, too ill to make the request, waiting for documentation from the DWP should be acceptable reasons.

The DWP does not have to accept the reasons for a Late request but if they don't then you would still retain a right of appeal.

Thank you for that.I've been waiting for a letter from my GP to submit with my MR and need to see how he's worded it ,but I've also recently had to go for a medicolegal appointment in relation to an accident at work back in 2013 which is what has caused my CRPS and the report is brilliant as it goes in depth about my physical and mental health and it clearly states that from this pain specialist's opinion who is a professor, that i am in no way fit to do any form of work for numerous reasons ,but my solicitor won't let me use it until some amendments have been made to it.So as long as I know that there is definately some movement on the 30 day deadline ,I'll wait until I have it all to submit together being as I have informed the DWP that it will be late being submitted.

Hi CAP

Personally I would send in a MR within the one month time limit and add a note that you are waiting for a support document and will send it, in support of your MR as soon as you get it.

As Gordon says you can apply for a MR within 13 months but you have to have a good cause such as hospitalisation or mental health reasons, waiting for a support document may not be classed as good cause.
