Hi im new and a silver surfer so im a little nervous with my first post but any help will be greatly appreciated.
Hubby has just received his dreaded letter about his pip assessment and has missed out by 1 point on his daily living but has the full 12 points on his mobility.
He had a stroke and heart attack coming up to 2 years ago,Osteoporosis,Osteoarthritis,Chronic depression and anxiety,insulin dependant diabetic with neuropathy,ulcerated feet,right sided weakness after the stroke,cant grip or walk and uses a wheelchair.
Can only say what a load of rubbish the assessor had written and far from the truth.
Said he handled paperwork in both hands without a problem and used an elastic band? in both hands showing dexterity, total fabrication as i sat at the desk with the paperwork and hubby did not handle anything ? His hand does not function and is clawed due to the stroke and cant raise his arm.
Also said no problems with his eye test?he didnt have an eye test again total fabrication as she didnt more from her chair.
He is having laser surgery because of a problem with cataract surgery so has vision problems.
No evidence of cognitive impairment?
A few more inaccuracies but would take too long to explain.
Sorry but is it worth a Mandatory Consideration i dont want to put him through anymore stress as hes struggling at the moment with it all.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation.

If you only want to argue about the daily living component then inform them in your MR request that you do not disagree with the mobility component, as stated above set out why you disagree with the daily living component, if you have additional medical evidence send it in with your MR request.
