Our son is 29.he has been in special need education since he’s was age 6.
He’s now attends a residential placement on a ( rise programme) funded by adult social services after a tribunal decision awarded when he was 26.
He had a mental breakdown and was sectioned 2weeks after starting this programme but returned after being discharged.
He has PIP high rate care and mobility.
He does not receive the high rate care because he is in a residential placement.
He receives ESA.
We have now been told that he will have to contribute 120 from his ESA leaving him with 28.but never been asked to contribute previously.
These are the only benefits he receives.
He is not in a care home it is a college environment but he is not in education.
We don’t want to claim any more benefits just to keep the ones he has.

I'm sorry, but this is outside the scope of this forum. You need to speak to a specialist welfare advisor. advicelocal.uk/ I have heard of someone in Kent suddenly being asked to contribute when they haven't before—but I don't know why the sudden change has happened for them either.

It sounds like they are applying the national rules for social care support in a residential setting. That allows them to take anything above the personal expenses allowance of £28.25 per week ( soon to rise to 30.15 ). The rules are different in community settings, so if he comes home during college holidays the community rules should apply.
