My ESA50 was sent to Cardiff ATOS, email address I sent it to is up North I believe.

ATOS Customer Relations Team are based in Leeds.

Receipt of your ESA50 would have been logged on their computer systems.

Been to CAB for advice, not sure it was the correct information.

Can you please clarify two points for me.

1. Been in the ESA Support Group for 12 months (was transferred from IB) and 7 weeks ago returned my 2nd ESA50, CAB told me that my payments would drop either to assessment rate or WRAG rate, please clarify.

2. If I want to move back with my parents and I get moved onto WRAG CB, I understand this would be for 365 days, they told me that my 365 days have been used up. I was then told if I was on WRAG IR they would take into acount my parents monies and assets.

Hi WD,

CAB have advised you wrongly, and you should make a complaint.

1. Your current ESA SG payments will remain until a decision is made by The DWP DM, even if it takes over the 12 months prognosis to make the new decision.

The three possible outcomes from the reassessment are the same as with your initial assessment.

a. Remain in The SG.

b. Placed into The WRAG.

c. Found fit for work.

Correct, in that if you were placed into the WRAG (CB ESA), payment of the CB ESA would only last for 365 days.

2. If you have never been in The WRAG of ESA in receipt of CB ESA only, you still have your full 365 days entitlement.

Time spent in The SG in receipt of CB ESA does not count against your 365 days entitlement.

12 Month Limit for ESA(CB)

What effect moving back in with your parents would have on them, or on your own benefits should be discussed face to face with a Welfare Adviser, (not the one that has given you the errant advice) where they will have access to all your personal details, and that of your parents.

We are used to claimants being given incorrect information by DWP call-centres, it is a real shame if we have to start expecting this from CAB advisors too! :(

Hi WD,

As long as the Solicitor specialises in Welfare Rights/Benefits, Yes.

The only problem is that the Legal Aid fund with respect to Welfare Rights has been slashed.
