Hi mv,

Just to clarify,

The success was with a long standing ESA appeal.

I think that The DLA "Fraud" issue is still ongoing. :(

Hi All,

Please bear in mind not to discuss by reference to any name of an ongoing fraud prosecution, as it is subject to the sub judice rule.

The sub judice rule regulates the publication of matters which are under consideration by the court. Matters are considered to be sub judice (Latin for 'under judgment') once legal proceedings become active.

Criminal proceedings are deemed active once a person is arrested, a warrant for arrest has been issued, a summons has been issued or a person has been charged and remain active until conviction. Civil proceedings become active, in England, when the hearing date for the trial is arranged and, in Scotland, when the parties' pleadings have been finalised and the record is closed.

Publication of material which is sub judice comprises contempt of court, a crime which is punishable by a fine of unlimited amount and/or imprisonment for up to two years. Third party costs orders may also be awarded against the offender enabling the courts to recover the costs of any trial aborted as a result of the prejudicial reporting.

Hi Jim

Fortunately Chrissy's case never went beyond an Administrative fine and it is this and the removal of her DLA that she is appealing.

Thank you , I have still got the DLA Tribunal to get through which seems to be speeding up all of a sudden and as yet no rise in my money or any back dated money, I rang up and was told they have got till 9th October.

Thanks for clearing that up Gordon you are right, and at the moment all my papers are with a solicitor and I am hoping they will take on my case, at the moment I qualify for legal funding of some description as I'm still only getting assessment rate ESA and the limit is about £99 , I haven't posted for a while I wanted a little rest from it all but no such luck they are still trying to grind me down.
