DLA - PIP/ DLA434 Rising 16's Question

Hi

I've recently been sent a DLA434/ Rising 16's A204 form from the DWP, as my Son who has Autism has just turned 16, and to be honest, I am confused by the whole thing.

Anyway the question I wanted to ask is, When it gets to the part about Care Needs, There's a bit at the top which says "You do not need to answer questions 37 - 56 if you have claimed for help with personal care and nothing has changed".........Which I thought was very nice of them, BUT, do I really need to fill this in just to be certain ?, as I can't really see why you have to fill in the Mobility bit and not the Care bit...............As I say, Nothing's changed apart from him being 16 now, but having phoned the PIP and DLA departments, they don't really seem to know what's going on themselves.

Any advice would help Please.

I don't know the answer- I've just received the same form but haven't opened the packet yet.

I was at a session about PIP and they were saying that, on average, the DWP have taken to shredding the forms after 14 months, so I can't see how they would have any information left from the previous claim if that's the case. :unsure:

So far I have spoken to about 4 different offices who all somehow seem to be involved in my son's Rising 16 claim. My son has autism, too.xx

I am sorry that we missed your post earlier in the week, thanks to CM for bringing it to our attention.

The DLA Regulations for Mobility are different for the under 16s than they are for the over 16s.

If nothing has changed in regard to son's Care requirements then I would avail yourself of the DWP's offer not to complete part of the form and just fill-in the remaining portion, however, I would include a copy of their letter stating that you can do this with the form when you return it.

I'm in the middle of the same thing. hadn't noticed the section that said about not answering the care questions. Went back and looked and it does indeed say that. Trouble is I'm already half way through this form now so probably best if I finish it now.
What are the differences in the mobility side of things post 16 then? I have been told that you can ask to switch from DLA to PIP. I was told this was even if you weren't in the areas PIP is being rolled out too. My son has severe learning difficulties and from what I can see would be better off under PIP. He has had high rate care and mobility for ten years. I have a few weeks left to finish the forms. Cant keep ignoring them!! We were due to swap to PIP then it was delayed. His DLA was extended for another year and then two weeks later I had the rising 16s forms through. Anything I should be aware of on rising 16s form or is it just like the adult ones?

The first thing to say is that if your son is receiving DLA Higher Rate Care and Mobility then there is no advantage to switching to PIP, the rates are exactly the same as DLA. Claimants who have problems going out alone and have a restricted ability to walk may be more likely to be awarded the Mobility component and more likely to be awarded the Enhanced Rate, as they will be able to score from both the Mobility categories rather than only one, but apart from this the criteria are very different.

The major difference is that below 16, claimants are compared against the capabilities of children of a similar age, above 16, there is no comparison and the test is an "absolute" one where you need to show specific needs for help with their care and mobility.

I am afraid I have not had sight of a Rising 16 form, so cannot comment on any differences from the adult forms.

Sorry, I worded that wrongly. I should have said that I think mobility would be awarded more easily for my son under PIP. He can not be left unattended anytime. Although he has had high rate care and mobility for ten years I am expecting his DLA to maybe not give him the high rate mobility again as I have heard of lots of children reaching 16 and having it taken away. I guess I will finish the forms and send them off, see what they decide
