ESA Superseding decision of TRibunal was created by catelilac
After nearly two years of DWP & Tribunals I am still not agreeing with their decision. DWP found that I would be fit for work working within 3 months which was overturned by Tribunal but I was put in the WRAG group. I appealed this but the Tribunals just don't get what living with M.E. & chronic pain syndrome. I have developed high blood pressure, hiatus hernia & other problems. Sensitivity to light and noise. etc etc.
The problem also wasn't helped by my doctor who simply refuses to give medical reports and only supplied basic diagnosis's in writing.
Eventually this year as my condition was much worse I asked for a superseding decision. As I had complained to my MP that they hadn't asked for a written opinion from my doctor the DWP then wrote to her.
My relationship with my doctor has been affected and I have not much confidence in her now.

The DWP have refused me into the support group again.

I have constant pain in my back & neck constantly and is aggravated when I am on my feet or walking. I am constantly exhausted and lye in my bed for hours at a time. why is this not being brought into consideration?

The DWP have made a new decision on your claim so you can ask for a Mandatory Reconsideration and then appeal, as with any other decision.

Mandatory reconsideration FAQs

I cannot even begin to guess why you were not awarded Support Group although the onus would have been on you to show that your condition had worsened since the previous decision and that you now meet Support Group criteria. Did you use our guides when filling in the latest ESA50?

I'm sorry you've has this awful ordeal. If you have no confidence or support from your GP can you move to another Practice or get a specialist referral ? is there anything in your medical notes from other health professionals that might have been missed ?

Thank you for your kind reply. Yes I am requesting a mandatory decision. but in the first instance I thought they would ask me to fill out some questionnaire again. All the new information they have is my doctors diagnosis. No-one contacted me to fill in any new forms. Im prepared to request a physical medical but I've already been here. So exhausting mentally but I will fight on x

Hi there thanks for your kind reply. My doctors is near my home but I might consider an appointment with someone else in the practice. Anytime I've spoken to anyone new they don't always seem to understand M.E. Still many doctors refuse to believe in it.
I'm quite angry now and have written to my pain clinic consultant who promised me support & then let me down. They emailed me to say she will see me again. I'm ever hopeful x
