We are at Tribunal stage challenging a DWP refusal to allow 4 points for the above descriptor. We have argued up to now that the claimant us unable to perform this task on the grounds that they can only move around using two crutches and thus has no hands free.
We note from your own guide that you disagree with the DWP guidance that meal preparation/cooking does not include carrying food to where it is to be eaten. We agree with your view of course. How can DWP expect a claimant to be able to perform the tasks individually (e.g. peeling veg) but discount the need to be able to move things around to finish the overall task of preparing/cooking a meal?
Are you aware of any developments (e.g. PIP decisions) to support your stance or indeed anything else that might support our case? Many thanks.
I am afraid not, we have still not seen any Upper Tribunal Decisions in relation to PIP and it will only be these that add clarity to the Descriptors, this of course does not prevent you arguing your case along the lines you have mentioned.
