Hello All,

Please could anyone advise if your entitled to claim ESA starting on contribution based and still be entitled to a employers group based income protection claim monthly remuneration payment whilst still technically being employed but on long term sick?

PS: Should the income protection insurance details be input on the ESA1 claim from at the onset?

You can still make a claim for ESA(CB) but depending on the terms & conditions of the income protection scheme it may come under the general heading of a pension and result in a deduction from your payments.

If it is then there will be an £85/week disregard followed by a £1/week deduction for every £2/week of insurance in excess of the £85.

You should definitely include this information on the ESA1 form, the DWP should then contact your employer for details of the scheme.

Hello All,

Please could anyone advise i am on long term sick with severe depression from my employer and recently my SSP ended therefore i applied for ESA & now on contribution ESA currently at the assessment phase and consequently awaiting to see if i will successfully be awarded group income protection insurance at a % of my previous salary minus tax/insurance & ESA sum that is paid directly to my employer as a continuation of my salary has to be declared to DWP as the insurance company automatically takes of the ESA sum at source and not directly paid to me

The primary issue is who has taken out the insurance and paid for it. If the scheme is paid for by your employer and you make no contribution for it then it should be disregarded, however, only the DWP can make this Decision so you must disclose the payments to them.

yes my employer has taken out and paid for the insurance policy and if I was awarded it would be paid directly to them then they would pay me as a continuation of my salary
