I'm currently the named claimant on mine and my husbands joint ESA claim however even after winning a tribunal last year i'm being reassessed again.

My husband is significantly iller than me and currently gets the enhanced rate of PIP.

We've been told to change the ESA claim in to his name would mean stopping one while he is assessed which could take months. Is there an easier way of doing this with him already having been assessed?

Any help is greatly received. :)

Your personal and financial situation is not entirely clear from your post.

From what you have written, I assume that one or both of you are entitled to and being paid Contribution Based (CB) ESA and your husband is receiving Income Related (IR) ESA for both of you as a couple.

It would seem that you wish to close your CB ESA Claim as you do not want to continue to have periodic reassessments to see which group you are in.

Even if you were to do this, which I am not advising you to do, your husband would still face periodic reassessments of his ESA.

Just because a Tribunal makes an ESA decision in your favour does not mean that you will not have a reassessment as with everyone else.

Under normal circumstances, the longest period that one can go without a reassessment is 3 years.

If you or your husband are entitled to and in receipt of payment of CB ESA, payment, that takes precedence over any payment of IR ESA.

If you did have a scenario in which your husband was simply to have a claim for both of your as a couple, it would not mean that he would be reassessed to see which group he was placed into. (WRAG or Support Group. (SG)

It would purely be a financial re-assessment to see what your maximum IR ESA entitlement as a couple was.

You should not make a decision to close your ESA Claim without face to face advice, as it could have adverse implications on your future entitlement and monetarily.

I may have misinterpreted your post, but if you can provide some more detail we may be able to advise further.
