Hello Everyone,
This is probably a really stupid question, but I shall ask it anyway (if nothing else you might have a laugh at how daft I am!).

My PIP claim is now at the stage where I have sent everything off to the Tribunals people, and am waiting to hear from them. I was just wondering if it is ever looked at and replied to without a hearing? The reason I ask is that I had to go as far as tribunal to be put in Support Group for ESA, and on the day of the hearing, one of the panel rang me to say I didn't need to attend because they'd looked at my paperwork and agreed with me.

Is this something that quite frequently happens? I just get myself in such a state about going out and facing strangers, so I'm dreading a hearing. Clutching at straws I guess you'd call it!!!

There are two things that can happen, the DWP usually looks at any appeal a couple of days before a hearing to see if they can revise the Decision in the claimants favour, if they can then you will be contacted you and the appeal will be lapsed (cancelled). An increased award does not necessarily mean that it is the award you believe you are entitled to, they might only increase one component, this new Decision is appealable.

The Tribunal panel will look through the appeals for the that day either the night before or first thing in the morning of the hearing, if the panel agrees that an award can be made and there is no outstanding issue of the level of award to be made, then the Clerk of the Court will contact you to say that you do not need to attend. In practice this would only happen if they were prepared to award to award the highest rate for the benefit.
