PIP Medical documentation returned by DWP within 2 was created by J The Divine B
DWP in Scotland returned large bundles of medical and supporting evidence by special delivery two days after England PIP office receiving these two bundles which accompanied recorded delivery despatched PIP questionnaire.
A DWP slip accompanied the returned bundles and stated that photocopies were made for the records ---but nothing was stated that the evidence would be relied on for PIP assessment. Thereafter the DWP has failed to respond, after one week, to confirm further recorded delivery requirement that that the medical and supporting evidence in the two bundles shall be relied on by HP and DWP decision maker.
Anyone else had similar experience?

Was the information submitted with a PIP2 form?
It is not usual for the DWP to return a claimants evidence, did you submit originals?
Have the DWP explained why they sent it back?
The assessor and the Decision Maker are obliged to consider all of the evidence submitted as part of a claim. You don't say what the large bundles contained, whilst there is no limit to the information that a claimant can submit, as a general rule the newer and more closely related to the PIP activities the information is the better.

Dear Gordon
1 No originals were sent with the two bundles of documentary evidence
Bundle 1 (100 pages)contained tabulated and enumerated Prescription, GP, A&E, consultants, community adult services, IAPS reports and all the records for aids and appliances. Most of the evidence was robustly pertinent to the functional difficulties consequent upon physical and psychical impairments.
2 Bundle 2 (100 pages) contained supporting evidence about the psychical traumas confirmed in Bundle 1 medical reports. Bundle 2 documents included three letters of apology made by DWP two years ago (after I sent them the grounds for Tribunal appeal) for stopping ESA (and DLA benefits). Also included were two apologies from another gov. department for its role in this matter.
3 Helpful DWP officer recently printed off and supplied to me all the documents that the DWP had scanned from the original two bundles, and also from my third bundle (sent separately by recorded delivery)comprising most recent medical evidence and further supporting evidence.
4 The contents of the officer's response package confirmed that:
70% of Bundle 1 medical evidence was missing
100% of Bundle 2 was missing
75% of Bundle 3 was missing.
5 DWP designated local office for submitting PIP 2 will not acknowledge or respond to further recorded delivery letter requesting corroboration that all tabulated contents of all three bundles were supplied to Atos.
6 Despite two recent recorded delivery letters and emails to Atos (prior to and immediately after face to face) they have persistently refused to categorically/specifically corroborate that all the tabulated and enumerated contents were scrutinised and relied on for PA1 or PA4 reports.
7 At rescheduled f. to f. at 9am--one day's notice given --as original appointment could not take place due to very long consultation for previous claimant, the TWO HP's had only 15 minutes to scrutinise all the evidence in form and bundles, prior to the consultation.
8 I placed the three bundles on their table and requested they confirm that they had copies of and had scrutinised all the contents of each bundle. Repeated response was they had all the evidence. They declined to look at the relevant documentation in most robust Bundle 1. Eventually they caved in and perused the relevant tabbed documentation for GP and consultants and aids and appliances. The senior HP commented that my documentation was indeed very well organised.
9 NOTE! In my case the DWP not only failed to send over 75% of my documentary evidence to Atos, but the scanned copies of the three bundles (supplied by the helpful DWP officer) were also totally scrambled up and without a coherent, tabulated thread.
10 Have now requested copies of PA1 and PA4 from DWP by telephone.
Any one else having similar experiences? BEWARE OF SUCH TRICKS

Thank you for the update, no this is not usual, but 200 pages is a lot of paper to send as evidence.

Thanks for feedback.
The volume of evidence was necessarily generated consequent upon multiple unlawful/maladministration/cover up of medical evidence in the acts and omissions by DWP (and Capita, not just Atos) and other gov. depts in complex matters outwith the ambit of benefits issues.
Significant in current migration to claim PIP is that:
1 Every document relating to apologies forced out of the above gov. agencies (including gov. dept directors' apologies and admission of Capita culpability in stopping benefits and which preceded Atos PIP involvement; MP concurred that Capita was at fault) was clearly filtered by DWP dedicated office and not sent to Atos. DWP office refuses to respond to recorded delivery letters raising this matter. 'Understandably', Atos refuses to send specified sample copies of core medical documents which were clearly not sent to them by DWP. Atos claims to have all evidence supplied by me and I called their bluff. Now all is the usual cover up.
2 The same fate met the documentary evidence preparatory tribunal bundle and apologies forced out of DWP for previous unlawful stopping of benefits, and consequent psychical traumas confirmed by GP and medical consultants.
3 The same fate met the majority of GP and consultants and A&E and community and psychological assessments and also aids and appliances reports
Lesson to be learned is that no matter how well one prepares, the DWP-Capita-Atos are not to be trusted to act transparently or as required by DWP guidance.

Hi J
It is becoming more and more apparent that the DWP and assessors are not reading all the evidence submitted with claims.
This is wrong on so many levels but it gives claimants lots of ammunition when dealing with wrong decisions.
I would suggest you contact your MP and submit formal complaints to DWP and Atos, copying in your MP.
