When someone starts work and comes off from contributions based ESA, is there anyway to reclaim after the linking period has lapsed?
Or would they effectively have to work 2 years straight full time to be eligible again in the future?
Friend has been on C based ESA SG for about 4 and a half years.

Hi JCP,
Once 12 weeks or more have elapsed, any ESA claim would be treated as a totally fresh claim.
On claiming, your friend's NI Contribution record would be checked for the two previous Tax Years .
Currently, the Benefit Year is 2015/16 so the two relevant Tax Years to check NI Contributions would be 2012/2013 and 2013/2014.
The relevant Tax Years roll one year forward from the beginning of January each year.
In order to qualify for CB ESA once more, they would need to meet three NI Contribution conditions.
Put simply :
1, They would need to have 12 months of NI Contributions in the two preceding tax years to the current benefit year.
2. They would need to have two years of NI Contributions and/or NI Credits in the two preceding tax years to the current benefit year.
3. One of the years used must be later than the years used in the previous ESA claim.
If they don't have enough NI Contributions for CB ESA, they would be means tested with respect to capital, assets, savings, other household income and any hours worked by a partner if they had one.
Asset rule for receipt of IR ESA
24 hour work rule for payment of IR ESA
If they had no entitlement to CB ESA, and could not pass the IR ESA means test, they would receive NI Credits (stamps) only that would go towards their State Pension, only.

Would any years claiming conts based ESA count towards the NI contributions?
The 24hour per week rule for income based ESA, what if both partners receive middle rate care. and one partner who is not on ESA is working 36hours?

I'm afraid ESA does not pay Contributions only Credits.
There are some disregarded jobs but nothing for being in receipt of DLA or PIP.
