Hi there this is my first post.

I am so confused and scared to death!

After receiving my ESA50 form I joined this site and asked the CAB for help filling in my form, this has now been completed and returned. BUT while there the advisor told me she thought I would be entitled to PIP and on my behalf started a claim. I was advised that my lifetime award of Motability wouldn't be included as it was a different part of the process.

Now after receiving the BOOK for PIP I find that in starting the claim that I cant stop it and in doing so my Motability award is now at risk. I only have until 10/1/16 to return the PIP form and have no clue what to do.

I understand that at some point in the future my Motability would be re-assessed but this all seems to much and if I am honest I'm not handling this very well.

I dont even know if I have a question its more to clarify if the advice I was given was wrong or correct as the case may be?

If you had the higher rate mobility component of DLA which you used to get a vehicle from Motability then your advisor is wrong to suggest you can claim PIP without putting your current DLA award under threat.
The whole DLA to PIP project has been rolled out cross the country and all indefinite or lifetime awards do not exist under PIP. You would have been transferred from DLA to PIP at some point anyway.
However by starting the process your advisor has put your current DLA award at risk since PIP is a completely new benefit with rules and regulations that aren't so easy to get awarded higher rate mobility so your car could be taken off you if you don't get awarded it, even if you appeal immdediately.
As your advisor is working for the CAB you should contact them and make them aware that they are telling you untruths. Your current award is at risk including your Motability car.

thank you, after reading the information here I know now that this is the case!

She started the claim for me and as I have found out I cant stop the claim. if you know other wise please let me know. I feel really let down by the people who are there to help. I do realise that I would be re-assessed at some point but that point need not have been so soon.

Its bad enough having to go through the ESA process and now having to start the PIP process at the same time. there is enough confusion out there :(

Hi

You cannot stop the process now she has started it. Hopefully she will build a brilliant claim for you with lots of supporting evidence and full answers to all the questions and you will get to keep your vehicle.
