Trial separation - ESA/PIP affected? was created by Melanie Tudor
Hi, if my query is straying onto other benefits, and not just ESA/PIP, then please just say and I will try and find the information by another route. thanks
I am on contribution ESA support group and have been since 2010 - (usually reviewed every two years but haven't heard anything for about 3 or 4 years and still getting the money) and PIP - enhanced rate daily living component and standard rate mobility (have been on DLA since 2010, and current PIP award til 2017) - both awards are relating to mental health, not physical health.
I am looking at the option of separating from my husband (due to the stress of living with his adult daughter aged 21 - long story). What I want to know is, if I move out of the marital home and rent a property on my own, will my benefits in anyway be affected, and would I be able to get my rent paid if I no longer live with my husband who is working? Would I have more rights to stay in the house and he and his daughter move out? (it is only temporary but the current situation is intolerable).
Should I be seeking information about this issue elsewhere? Sorry, if this question is outside the remit of B&W.
thanks

Hi
I may be wrong, but I think your query is outside the remit of this forum.
I would suggest that you approach a solicitor (many offer a free initial consultation) and ensure that you have the best advice available. I don't think your ESA award will be affected in any way; but allowances for rent/mortgage etc are being tightened up along with most other allowances and you really need to have the full facts before making any decision. If the house you live in is in joint names, the situation could be very complicated - I really do think you need to see a solicitor.
Good luck.
