DLA was created by John Scott
My wife was awarded DLA on the 17th Feb 2011 after I appealed against the Secretary of State.
Her award states that it is for Life and that it is a final assessment.
We have to apply for PIP, and although I sent a copy of the Final assessment ATOS have ignored my letter as have the Benefit Dept.
Surely this is not legal?
Any ideas if anyone is trying to stop this happening

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi John and welcome to the forum. You should find that this link explains how the forum is run and where to find things.
Welcome to Benefits and Work
I have removed your surname form your post as many people prefer to maintain a degree of anonymity.
I'm afraid that the law was changed to allow for this. If your wife was less than 65 years in April 2013 she will be 'invited' to apply for PIP at some stage.

Just to add to the advice already given, the award criteria for PIP is very different from DLA and the assessment process is also substantially changed,
I would not rely on a previous DLA report as the only evidence and if you have received a PIP2, this must be returned or there is a risk that both the DLA and PIP claims will be closed.
