in danger of sanctions due to ESA50 not done

I have been unable to return the form on time (M.E sympotoms and anxiety depression panic atttacks) and lack of help with form
Was due in today... woman said she cant offer extension and just return asap
Though threw in a reference at end that i may have a a week or so before they suspend my benefit

Was the Benefit, Enquiry line though she mentioned another department, i think payments...
Who would make the decision..
she said send any reports in with the form but i have nt got any recent reports..just things from 2012

The GP said they will do the form but not a letter in advance..

I cant get any help with the form..
my handwriting is appaling so if i try to fill out by hand they wont be able to read it..
someone said if it is typed that may go against me as it will look too organised..
though i will have to get someone to help with that... but they wont send a letter saying they have helped me..

Should i try ringing another dwp department- woman i spoke to said not to bother as wont make a difference... they dont give extensions any more?

the advice placeI i went to dont give help w forms anymore..

Anyone else been sanctioned or had experience and can people direct me what to do..
Find it hard to sit at computer too long so will take me at least a week though will make me still more unwell to try and do
better to fill out badly and have to go to appeal or do it well and get sanctioned?
can you submit reports later at appeal stage?
i am in support group and really worried as dont have key or support or socal workers..
just couple people who come now and then and make soup for me - might be able to get one letter from them..
o wise i would nt eat..

Hi MK,

Welcome to Benefits and Work :)

Your ESA payments will not be "Sanctioned" as such for non return of your ESA50 !

However, the likelihood is that Maximux will return your file to the DWP who may then stop your ESA payments for "failure to return the questionnaire without "Good Cause" ".

This decision is appealable !

If you have Mental Health issues they are supposed to make some allowances for this.

thanks, i have managed to get some help and thankfully located teh old esa50 i had done before so have filled it in..
Can i just ask quickly how many points u need for the support group on esa?
I have mh just depression and anxiety and a few physical indicators for M.E/CFS

is it worth ringing them on Friday maybe to say form is on way? I think i should be able to get it in post by Friday a.m
Was due in yesterday (Tuesday 2nd Feb)

And is it best to send any other reports after then?

Gaining access to The SG is not reliant on you scoring points, points are only relevant to qualification for The WRAG, where you need to score a minimum of 15 points cumulatively across all/any of : The Functional WRAG (LCW)Schedule 2 Descriptors

To gain access to The SG you just have to qualify under any one of : The Functional SG (LCWRA) Schedule 3 Descriptors

(As you may notice, some but not all of the highest scoring WRAG Descriptors correspond to some of The SG Descriptors)

If you cannot qualify for The WRAG or The SG as above, another avenue is via : ESA Reg 29 for entry to The WRAG (LCW)

PLUS Post 28/01/13 Amendment of :

(3) Paragraph (2)(b) does not apply where the risk could be reduced by a significant amount by—

(a)reasonable adjustments being made in the claimant’s workplace;

or

(b)the claimant taking medication to manage the claimant’s condition where such medication has been prescribed for the claimant by a registered medical practitioner treating the claimant.”.

You could contact : The Centre for Health and Disability Assessments (CHDA) (aka HAAS) (Maximus) who took over the ESA WCA Contract from ATOS on 02/03/15., but there is no guarantee that they will not have already returned your ESA file to The DWP.
