This issue has been going on for over a year, last year my ESA was stopped again due to non attendance of a face to face assessment,I had a long 8 week fight and my MPs input to have my ESA reinstated, I have continued with my insistence on a home visit. I have provided all the medical evidence but the company has changed fro ATOS to Health Assessment Advisory Service. When I received another appointment, I rung them to inform them of my need for a home visit,I explained what had happened last time and that all my medical evidence in support of my home visit request had been sent in, they were not aware of this , I was able to change my appointment date but needed to once again obtain and send in the information , I was due to go on the 27th of January despite needing a home visit , that day I was physically unwell , I think due to the stress as I have server social anxiety and am unable to go outside and had no carer to go with me, I explained I was in the process of having a letter typed and sent from my GP but there is a 6 week turn around for dictation and typing at our medical centre. I was told I could not change the appointment again as you only able to change your appointment once and the DWP would be informed of my nonattendance. I have today received a letter to say my ESA has stopped , I spoke with a DWP employee on the 1st of Feb and explained this ongoing issue of needing a home visit, that I have sent all medical evidence in the last time I was summoned for an appointment , explained that I requested and was given a home visit for my PIP claim but still my ESA has been stopped, along with the letter from the DWP, I also received my P45 etc, so the claim has obviously been closed. I spent 50 minutes on hold to the ESA enquiry line yesterday to be told that no decision had been made and to ring back on Monday which was obviously very wrong. I am not sure what to do ....

Send a recorded letter telling them they are discriminating against you on the grounds of being disabled and contrary to equalit law.
State that you will take out an injunction against them if they do not attend for a home assessment.
Be prepared to follow through.
It is ridiculous the way we are being treated by this government. They have already been warned by the UN as to their treatment of sick and disabled citizens.
I bet they do a home assessment.

Thank you for taking the time to reply and for your advice, I have written a 6 page letter in order to request a Mandatory Reconsideration, detailing all of my contact and evidence i have sent to them. Last time it was an utter nightmare and we were left 8 weeks with very little money to live on. I am dreading it again.
Is there anyway I can obtain the information they have about me and my claim? All this evidence etc has to go somewhere surely .

Hi
Yes you can submit a SARS request for info. It is similar to a freedom of information request.
They have 40 days to supply or state why not.

I have been told today that I now need to claim JSA under the extended sickness rule ??????, how can I claim JSA ? I am far from fit for work, I do not go out of the house because of server social anxieties, My partner cares for me and my son, my son and I both get PIP, although he can only get Carers Allowance for me. I have been told there is no Hardship claim when you have been on ESA , it only applies to JSA claims that have been stopped. I have been put through to so many different departments and been on hold at times for up to 50 minutes only to be cutoff. I cannot get any straight answers at all. I have put in a Mandatory Reconsideration request today but have been told it will take 14 days to be looked at. I have no idea what to do.
Anyone got any suggestions or advice please?
