I have just discovered this website and wish I'd found it earlier. I was totally unprepared when I filled in the ESA50 form. I was quite vague in my responses and also after days of just sat staring at the forms,I rushed through it at lightening speed due to the sense of dread I get when faced with forms. Hence to say I went to my f2f totally unprepared. As a result I failed and now I have a date for my tribunal hearing ,which is at the end of the month. Since my f2f my condition has worsened and I am also now showing signs of fibromyalgia for which my gp has refered me to see a rheumatologist. I am lead to believe that the tribunal will be based on my condition at the time of my medical. Will the judge and doctor take into account my new symptoms ? Can I put in a new claim before the hearing or would it be best to wait till after I've seen the rheumatologist? Thanks in advance for any light you can shed on this for me.
Hi If you want to say your condition has worsened and affects your ability to carry out the descriptors you will have to start a new claim. It may be best to go to the tribunal as is and concentrate on getting enough evidence and showing where the f2f report didn't accurately report your current difficulties in carrying out the activities if you feel you have enough to get you the award you think you deserve. If your worsening condition will score more points and put you in a different position then maybe make a new claim. You could fill in a form with your new condition and be able to make an immediate claim if you don't get your award at the tribunal. You could also then wait for the rheumatologists opinion.
