An interesting thing happened and we are wondering whether this has anything to do with us complaining or if it is just a coincidence?

The day that the MP agreed to act on my sister's behalf she received a letter from the DWP with a capability for work questionnaire enclosed. She has already completed one of these recently and completed one when she was transferred from IB to ESA. After the last questionnaire was completed she was notified that she was awarded ESA Contribution-based (support group) and was not required to attend for a medical.

It seems rather odd that having complained about the conduct of the DWP she is suddenly sent yet another capability for work questionnaire.

If they now make her attend for a medical, which is going to be very difficult for her because of her physical problems and pain...can they then make her have another medical for PIP when she eventually gets the claim form?

Although there are similarities between some of the activities for ESA and PIP the actual criteria are different and require separate assessments, so it is perfectly possible that she will have one for any future PIP claim as well as one for this ESA reassessment.

PIP and ESA use different computer systems and the staff are separate, it's not impossible that the complaint initiated the review but I think it very unlikely.

Thank you for your reply Gordon. Wasn't sure whether it was just coincidence. :unsure:

Some more good news this morning - and without the MP doing anything.

DWP wrote apologising for the standard of service my sister has received - the clerical form has now been sent (hooray!). The officer who wrote said that she would oversee the claim and ask the decision maker to backdate any subsequent claim awarded to when she first applied. :)

That's terrific news I'm just sorry you had to go through all of this when they should have sent the form when originally requested.

It's nice to hear that DWP have issued an apology and someone is going to keep an eye on your sister's claim to see that things run as they should.

As Gordon says, it would have been even better if things had been done properly in the first place!

This is just a quick update on my sisters' claim. The ESA form was completed and returned but she has still not heard the result of that as yet.

The clerical form (the one they do not produce) finally arrived almost two weeks after they said it was sent and this was completed and returned. She has now received the second form that asks for a lot more detail and we are about to start completing that as it has to be back with them fairly soon. Hopefully the process will then be fairly straightforward. Will let you know how she gets on.
