After I lost my PIP appeal I asked for a Statement of Reasons which I received the other day. I was flabbergasted that they have actually lied and twisted things around. they asked me why I could not attend for 5 days in August, which was because I was away for that period. I told them it was my one and only break in 5 years. They have stated that I was going on holiday regularly and many other activities that I apparently highlighted to them!! Absolute nonsense. They also have stated that the tribunal considered that there was the possibility that the existing award of PIP should be removed, but the tribunal was not in agreement. This was not mentioned to me at the tribunal, and why would they do that?? The tribunal also stated they were concerned that I said my spinal cord stimulator was not a cure (which it isn't) .They then contradict themselves by saying, the implication is that she thought it was a cure! There are many more statements which are incorrect. How can I take this further, as they have lied and my partner was witness to what was said at Tribunal. I don't know whether false statements is an error of law, and if not what does it come under? I really can't take much more of this. Thank you

Did you request the Record of Proceedings as well?

Errors of Law are not always easy to show, I'm not sure any of the issues that you raise are slam dunks for this, you would need to show that they had a material effect on the Decision that was made.

My best advice is to get face to face advice, you need someone who can actually read the SoR, do an internet search for "welfare advice" with your postcode, town or county.
