Do I get ESA Getting Higher Rate PIP Care?

There was a clause in DLA with which if you were getting higher rate care you also qualified for ESA payment even if you were getting an occupational pension which took you over the threshold to receive any payment.

I was getting DLA at middle rate care and higher rate mobility. I was getting an occupational pension so ESA paid for my NI contributions, but no money because of my pension.

I have just been awarded enhanced care and enhanced mobility on transition to PIP....It was a great relief...MANY, MANY grateful thanks to B&W for all the help and guidance!! :cheer: :)

I contacted DWP because I was on enhanced care and was told that I my occupational pension amount is too high to receive ESA and you don't receive it just because you get enhanced care.

This was NOT the case for DLA. I know somebody who receives ESA payment because she is in the higher rate care and DESPITE having a pension higher than I receive.

Can anybody clarify please?

You are partially right. It was the Incapacity Benefit legislation that covered this not DLA.

It only applies to ESA if you qualified under IB and were subsequently transferred to ESA. If you did not qualify under IB or have only claimed ESA then the disregard does not apply.
