Hi I sent the paperwork to tribunal service re my husbands ESA reconsideration being turned down I also sent paperwork to DWP in relation to this and asked for all their info they used to make their decision. but I forgot to ask in either letters and paperwork that my husband wants his ESA reinstated at the assessment rate during the appeals process. We received a letter to day from the court confirming that they have received the paperwork for the tribunal. They have also forwarded the relevant paper work concerning the case to the DWP. will the DWP automatically reinstate my esa or do I have to ask them by phone or letter. I am getting income support in place of this as I am covered by a sick cert until end of January so did not need to sign on as my husband is not fit for work but I believe his stamp is not paid during this time but the money works out the same.
Any advice please.

Hi Linda,

You need to contact DWP and ask to be put back on the ESA basic rate. You need to submit Dr's notes in order to be paid.

Each party to the appeal will be sent an evidence 'bundle' containing all paperwork associated with it, so don't worry about asking DWP for copies if you have not already done so.
