Hello, After a serious accident at work, I used my savings until In was forced into claiming ESA and later PIP. I am in receipt of PIP and contributions based ESA. I have been advised by my Barrister that I will keep my benefits (obviously as long as continue to meet the criteria). But, wanted to check this this correct. The back dated money is being paid back directly to the DWP. Thank you very much.
You will certainly retain your benefits as long as you continue to meet the criteria but you should talk to your Barrister as the DWP may want to claim some or all of the benefits already paid from any compensation that you might receive.
