Hi Gordon I was not clear I have been awarded lcw 15points however in my appeal papers from dwp they have enclosed if I am awarded lcw the following paragraph is included I'm v sswp ESA 2014 a three judge panel of the upper tribunal held that in appeals about whether the claimant has limited capability for work the ssof stated response should include a submission about whether the claimant has limited capability for work related activity The submission need only refer to the relevant legislation and need not explain why those provisions do not apply as this will be implicit from the explanation as to why it is considered that the claimant does not have lcw ??????do not understand
You do not need to worry about this, the panel will have looked at whether you met the criteria for Limited Capability for Work, which you did and for Limited Capability for Work Related activity, which you did not. The remarks by the DWP refer to the latter only.
