pip tribunal was created by nicster
Hi, I wondered if anyone can help me. I was awarded PIP standard rate for both at mandatory review for 2 years. (decision date 30th June backdated to March 30th 2018) I am taking it to a tribunal as i think i should be awarded enhanced rate for both and a longer award. My question is this on the mobility component i was previously (march 2016) awarded 10 points for Planning and following journeys.e. Cannot undertake any journey because it would cause overwhelming psychological distress to the claimant. This time only 4 points-Needs prompting to be able to undertake any journey to avoid overwhelming psychological distress to the claimant. I know that this element was changed then reinstated by supreme court. I wanted to know if my claim would have been assessed by DM at DWP according to the new (reinstated) rules or not? When i phoned up the help line they said not to include it in tribunal as it would be looked separately over the next 2 years. They also said that the tribunal would not extend the award either could you advise me as to whether both these claims are true. thanks in advance for you help

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Descriptors (b) and (e) of the Going Out activity were not effected by the changes made by the DWP in March 2017.
I'm not sure what you mean by the "help line" but a Tribunal panel can change both the award and the award length.
The Going Out activity looks at three things.
Planning a route - this is primarily a cognitive or sensory (e.g. blindness) activity. You are being asked about the problems you would have with working out how to get from one place to another, you do not need to be able to follow the route that you are planning.
Undertaking a Journey - this is do with mental health issues such as agoraphobia and social anxiety and is concerned with you leaving the house to go somewhere, they will be interested in the things that stop you doing this. You need to show that you would suffer "overwhelming psychological distress" to meet the criteria.
Following a route - This activity about the problems you would have navigating a route. So are there problems cognitive, sensory or mental health issues that would prevent you from doing this? This is different from undertaking a journey, in fact if you cannot undertake a journey then you will not score points for following one and vice versa.
