Hi, My son has various medical problems and I applied for PIP for him last year. At first he was refused anything, and following MR he was granted standard daily living (enhanced missed by 1 point) and enhanced mobility. His condition has worsened and his dialysis changed from 3 times a week at the dialysis unit to five days a week home dialysis for five hours a day. He is very poohly with other various associated conditions which have also worsend. I wrote to them detailing all theconditions that had worsened and explained how his daily life was effected. I also sent in evidence to support this.
This was sent in back 7th March and my son received a text message a few weeks after that to say that it was received and was being looked at. it also said he would hear back from them within four weeks (he didnt tell me about this text till recently). I presumed that they were just taking the time as usual and called them a couple of days ago. They appologised (eventually) and said I should have sent in a change of circumstances form. I told them that I gave them all the information that they required, plus evidence in a similar vain to the form (I did this in order to avoid filling in another form). She read through the information that I had sent in detailing the change of circumstances and said I must appologise but you should have filled in a COC form. I replied explaining that I had written in March explaining the COC with supporting evidence and received a text acknowleding receipt so surely if a form was needed it should have been sent out for us to fill in (which it wasnt until a few days following my phone call to them the this week). This form sent doesnt relate to COC but is a fresh claim pack to start all over again. I am furious. Have you heard of this before and what can I do.we have already been waiting for over five months.

I did warn you four months ago when you asked about reporting a Change that it would mean a new PIP2 and almost certainly a face to face assessment.
The delay is unacceptable but any increased award should be back dated to when you notified them.

Hi Gordon,
Yes you did warn me. I wrote out the change of circumstances in their format with all supporting evidence. I was surprised when my son got a text message a few days later saying that we had no need to contact them they had received the information and we would receive a decision within four weeks. I left it as I know they are busy but nearly four months later I called and they said I hadnt sent in any evidence. I assured them I had as it was all printed and sent together. I explained that I had listed attached evidence in footnote, and she disappeared for a while and then the evidence was found. She then said I should have sent a change of circumstances form in. I explained that no one had contacted us to tell us to complete a forn, nor was there a form sent out. The only communitcation we had was the text message telling us to wait for decision. She appologised and said she didnt know what had happended and would send a form out straight away. But I did ask when his claim would start from as we have already been waiting for nearly 4 months. She said it would start from when they receive the form back. I have spoken to MP about this now but I still have to do the form.

You last posted three weeks ago saying that you had received a PIP2, it must be now due for return, please do not lose track of this, as failing to return the form will result in the claim being closed.
Any award should be backdated to the date you notified the DWP of the change subject to the requirement for the change to have affected the claimant for three months.
