My daughter (16 years) has had her DLA to PIP refused. 2 points for care at assessment. She was awarded high rate for both care and mobility under DLA. She has several long term documented conditions, both physical and mental. She suffers from very high anxiety, but my husband and I, along with her, decided to try and help her through the system herself, rather than be an advocate - we figured her conditions are not going to change, and it would help her to be able to help herself - if that makes sense. We filled in the form together, and I went to the assessment with her and spoke on her behalf. She answered some on the questions but with support and prompting by myself. The report reads she was able to look assessor in eye and did not show any anxiety symptoms - she internalises everything - she can cope if I am with her, but I can not be there, or should be there, for ever.

It has backfired hugely with the decision for no award whatsoever. The report just is not accurate (we asked for it to be sent to us) in any way.

The deciswion was made on the 20th July - we hadn't heard anything and was told this when we called. I disagreed with the verdict and asked my next steps - was told that we could put in a MR claim - which we have - trouble is we have not yet received the decision letter despite asking for it to be resent. We have had a text message saying they are reconsidering the decision.

I will put together a letter detailing why we disagree with the assessment but I have no idea where to send it. i have today asked again for the letter to be resent.

I guess the questions I am hoping someone may be able to answer are:

- Is there a standard address for MR
- If not, should I send my letter (recorded) to the general address
- I've not heard from Mobility (had car since 2013 - should I contact them

Welcome to the forum, you might want to have a look at the following FAQ which explains where everything is

The MR needs to be sent to the DWP office dealing with her claim, this will be on the Decision Letter or failing that the letter that accompanied the PIP2 form.

Motability are pretty fast at contacting the claimant once the DWP notify them, I would give it a couple of days and if you have not heard by then give them a call, they do offer a range of options for claimants transferring from DLA to PIP.

Thank you.

I now have the letter and assessment report.

I've been reading the forum and the articles and will refute the findings with facts.

The only query I have is can I write the letter myself on her behalf even though I am not officially her advocate - or do I need to write it from her?

You can write it for her, if she is capable of making the arguments herself then I would make it in the first person and if she is not then do it in the third person. In both cases, she needs to sign it, if the latter then you need to sign it as well. I would also include a short paragraph explaining how the letter has been produced and why.

One last question I hope you can help with.

We will keep the mobility car whilst we fight the decision - and beyond to the full 26 weeks we will be entitled to.

At the moment we do not pay the congestion charge (use car for GOSH visits) or the Tolls at Dartford - is the car still exempt and do I have to insure it myself now?

You need to contact the DVLA, there is no definitive statement in the public domain about these circumstances.
