Hi guys,

My dad applied for pip last year and got standard rate for care and for mobility. He should have appealed there and then but didn't and after a fall in December we put in a change of circumstances.

DWP then got back to us and kept his care at standard rate but removed his mobility. Requested a mandatory reconsideration and they did not change there response so appealed.

The mandatory appeal letter was dated 17 July 2018. I sent his appeal off on the 14 August 2018 (could not send it before as was waiting for letter from hospital to send it with), signed for next day and they did get it on the 15 August.

Got a letter last week saying the appeal was received late. Was it late as I thought we had until the 16 if August. The appeal said it must be logged within a month, not 28 days.

Do you think we would be penalised? Don't have any legal support or CAB assistance so doing this on our own.

By the way I think my dad should be on the higher rate for care and mobility according to his health conditions and calculating the points using the guide.

I would not expect it to have any impact.

Are you hoping he scores higher for Moving Around or Going Out if the latter then please make sure that you understand the criteria, based on what I see in the forum, many members do not.
