My area has just become UC live,so I am expecting to be transfered at some point.However I have heard reports that people on ESA IR with either WRAG or Support groups are not getting these groups automatically transfered and are having to be totally reassessed with a WCA.Is this legal and right? thanks.
Even though your area is moving to UC, no ESA claims are being transferred at this time, this process will not start before the middle of next year at the earliest and this date seems to be optimistic given the roll-out of UC to date.
Only those ESA claimants who have had to claim UC for other reasons have had their claims move, most often because they have moved from one Local Authority to another. There have been some administrative problems with these moves but the legislation requires any existing ESA award to be transferred to UC.
