Hello Gordon: So my understanding is current before I fire letters of complaint off to Ms McVey et al, what is the position with ESA disability premia in UC, please? My sis receives ESA (SG) and PIP. Her ESA includes disability premia. I understand, but cannot find confirmation, that there is transitional payment so that ESA recipients receiving such premia will be no worse off under UC.

1. Is this correct, and, if so, for how long is the payment (whatever it's called) intended?
2. If payment IS to be made to ESA recipients of premia, will they be no worse off than present?

There seems much warning that they WILL be worse off, but details are light.

The situation today is that there is no protection for claimants receiving the ESA Premiums if they have to make a claim for UC.

However, there are amended Regulations currently being discussed that will provide protection both for future transfers and those that have already been done but there are serious concerns being voiced about some aspects of these regulations, not specifically to do with the Premiums, so it may be sometime before they are put into law.

Gordon: Thank you. You confirm what I suspected but thought might be wrong - as it's staggering that UC could've been conceived with no such provision. Was the expectation, then, that claimants who'd received, say, enhanced and severe disability premia would 'acceptably' lose some £80/week in benefit? This is extraordinary! No wonder there's serious concern... Either Gov has to come clean and state that the disabled were receiving too much money and they're cutting it in UC, despite constant claim of support of them, or accept staggering incompetence in the implementation of UC. It reminds of the failure to pay so many these premia at migration from IS to ESA duo to incompetence and carelessness and the fallout that caused.
