Hi there,
Old topic but a new question.
As I outlined above my partner has been asked by my brother if she would be willing to sell some artwork that she had made.
I've read all of the advice Gordon gave previously and I am convinced that she would not be be in conflict with the rules regarding what constiutes Work Related Activity as she produces this artwork when she feels able and as part of recommended therapy. It is definitely not something she is required to do in any way.
My brother is keen to buy some of her artwork but my partner obviously doesnt want to take any payment before she has permitted work in place
We were just about to ask for the relevant forms for permitted work when my partner received an ESA 50 to reassess her condition. it's been 3 years or so since her last one so it hasnt come as a huge surprise.
What she cant decide on is whether to apply for permitted work while this reassessment is ongoing or to await the outcome and apply then. She's incredibly concerned that if she applies for permitted work now then it will just reflect badly on her ongoing ESA 50 application. However she knows that the ESA 50 process can take months to complete and she would like to get permitted work sorted out sooner rather than later.
Does anyone have any advice on this?

If you report the PW now then it is likely that she would be assessed on the basis of her doing the PW, this could result in assumptions being made about her capabilities.
If you wait until the new Decision is made then there is a risk that it could trigger another reassessment but this would be very unusual.
