Hello Gordon, please forgive me if I am doing this wrongly and should have linked it to something else perhaps?

Anyway, I am totally despondent and feel like I am trying to fight a hopeless cause.

Briefly, I was on PIP standard care and enhanced mobility. I had a horrendous interview before Christmas, and my award was changed to standard for both care and mobility. The lady had told blatant lies. I requested an MR, the result of which I received today. As I probably expected, but was still shocked at, there is no change to the award. I feel so, so upset. It’s like a kick I. The teeth, as if the DM is saying I am lying.

What do I do now please? How do I set the ball rolling for a request for a tribunal? I am just so down I. The dumps, I haven’t really got the fight in me today, but know I just have to pick myself and dust myself off etc etc.

The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.

Thank you, Gordon. So do I have to ring and tell the DWP that I’m going to ask for the tribunal stage, or just complete the form and send it off?

Amanda, you are not alone, believe me. Give yourself a few days to let the shock subside, then have a look at the MR decision dispassionately, see what's wrong with it, and in particular those aspects which have led you to being reduced in mobility, and challenge them. You need to lodge the appeal within a (calendar) month of the date of the letter (allowing for postage time), so if it was dated 2nd March it would need to be received by 1st April, I think. See if there's anyone (Citizens Advice Bureau, a charity dealing with your illness/disability, local legal advice centres etc.) who can help with advice.

(Gordon, thanks for the confirmation that you don't need to quote chapter and verse at this point. I've just sent an appeal in which does, unfortunately, but I guess there will be more to come when we get the DWP submission)

The form goes back to the Tribunal Service, there is address information on the form. Once you make your request you should not communicate with the DWP about any issue related to your appeal, you should only speak/write to the TS, they will pass the information on to the DWP.

Hi Gordon,

Can you tell me if a tribunal panel can change the length of an award as well, or just the points awarded please?
