New pip claim was created by Margo14
Hi was wondering if someone could advise me I applied for pip and I have received enhanced rate for care and only 4 points for mobility , the thing is the HP gave me 8 points and the DM reduced it to 4 do you think I should do a MR or should I just leave it

Does the DM explain why they only awarded four points and what was this for?

The 4 points were for can stand and move 50 but no more than 200 but the assessor awarded me 8 points for can stand and move 20 meters but no more than 50 meters they say its because im not on strong painkillers ,the assessor seen me struggle into the assessment room ,says I receive low dose pain relief I take amitriptyline 200g and co-codomol 30/500g 2 four times a day and it says I said I could walk 1-2 minutes without stopping

I think it likely that it is your saying that you can walk for 1-2 minutes that has caused the problem. The average walking speed for a healthy person is 72m, even if your walking is slower, in two minutes you would easily cover at least 50m.

Some things to think about

You are not required to walk pain free but any pain that restricts the distance that you can walk should be taken into account.

Specifically for the Moving Around activity, if you are able to walk but you are in severe pain when doing so, then you can argue that your walking is not to a necessary standard and should be disregarded.

The legal test requires you to stand and then move (walk), so if you have problems getting up then you should document these as well.

If you walk slowly then it must take you at least twice the time to cover the 20m as a healthy person would, this could be down to the speed of your walking but could also be the result of having to stop.

You must be able to repeat the distance, so if you could walk it once but not then be able to walk it again within a reasonable timescale then you should be classed as unable to repeat the activity.

I'm afraid I can't tell you how to show your walking is more restricted but things you need to think about is what you can't do, for example what can you walk in your house, how far is the toilet from where you normally sit, things that will count against you are any trips that you make outside, so for example, how do you do your shopping?

You must be able to walk the distance you can, reliably and on the majority of days, both these terms are defined in the PIP Claim guide

Thank you Gordon , I did say on my original form that I had to push through the pain to be able to walk 1-2minutes about 20 meters and at assessment I didn't say how long she said that I could walk 1-2minutes and it was 33 meters to the assessment room and I did stop twice on the way there , just wondering if I explained it better in MR would it only be the mobility question they would look at or would it be the whole assessment

You can ask them to just look at the Mobility component but the DWP can look at the whole award if they want to.
