Feeling Victimised and Fobbed Off! was created by Shelleve
Hello. Both my Husband and I are on a joint ESA claim, in Support Group. I am on Income Related, my Husband is on Contribution based. We think he should be on Income Related. Could you please advise how we go about having this checked and how we request it to be changed if that's the case and if we need a certain form, where can we get one? Thanks.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Only one person in a couple can claim Income Related ESA, so the only way your husband could make a claim would be if you closed your claim and if you are not yourself entitled to Contribution Based ESA, then this would mean closing your ESA completely.

Thank you. That has put our minds at ease. We did not know that. dwp totally confuse us. We have been on a joint claim for 3 years. At first they didn't put us on a joint claim, we didn't know this but we're unsure if it was correct that we were on a joint claim but being paid separately, so we contacted them and they informed us that we weren't on a joint claim, it was there mistake and they would put us on a joint claim straight away. This was sorted out. Then we received 3 letters stating that my husband's contribution based esa was ending. That's what's confused us. Since then I qualified for pip. My husband claimed carers allowance. He was accepted and we thought everything was fine. No. My husband was due a payment of carers on Monday (8/4/19), he did not receive it. We contacted carers line to be told my husband cannot claim carers allowance because he is on Contribution based esa. We are now in shock and nervous wrecks. They said carers is suspended and it's being looked into. esa stated everything is fine with our esa and it's definitely a joint claim. Any advice would be most welcome. Thanks.

Carers Allowance and ESA(CB) are classed as overlapping benefits and only the one that pays the most will actually be paid.
You said that your husband's ESA is ending, why and when?

My husband's esa is not ending. In 2016 he received 3 letters stating contribution based esa was ending because of the 365 days. but his es a continued.
