Hi, can anyone tell me if the PIP assessment by Independent Assessment Services where it states that you can record a face-to-face consultation only if you tell them three days in advance and produce two identical physical copies on CD or cassette at the end of the consultation is a legally valid constraint?
I have just received a letter informing me of a face-to-face home consultation in five days and accessing the equipment required is an impossibility for me.
Although I could record the consultation on a smart phone. Would that be acceptable at a tribunal appeal?

Overt recording are at the discretion of the Assessment Provider and the actual assessor, you have no legal right to require that the assessment is recorded, so it's their party and their rules.

Even if you are given permission, you cannot use a digital device to record the interview, it must be simultaneously to two CDs or tapes.

You are legally entitled to make a covert recording for your own use but if found to be doing this then the assessment can be terminated and you would be classed as failing to participate.

A recording can be used as evidence at a Tribunal, even a covert one, the panel has the authority to allow it but the reality is that in the limited time allowed for a hearing they will be far more interested in understanding how you meet the Descriptors for the benefit than looking at issues in from the face to face.
