hi guys, 2 car accidents, left with perminant injury
slipped disc in neck
trapped nerve both shoulders
trapped nerve lumbar spine
sciatica left leg
2 fractured feet
2 knees damaged lips and pelvis injury both sides
ESA zerp points work capability assessment
1st tier appeal scored 6 on mobility
effects of condition on body vary throughout the day even on a good day not fit to work even sedentary part-time role
thanks to all in anticipation

Welcome to the forum, you might want to have a look at the following FAQ which explains where everything is
Welcome to Benefits and Work
Whilst it may seem counter-intuitive, the ESA assessment does not look at whether you are Fit for Work or not, instead, your ability to complete a set of activities is considered and if you meet the criteria for an award then you will be considered as Unfit for Work.
If you did not explain your conditions and limitations in regard to the ESA activities then it would be easy for you to have failed to score.
As you have taken your claim to appeal your options are now limited, unless you can show a significant deterioration in your original conditions or you now have a new condition likely to result in your being awarded ESA then you cannot make a new claim for ESA.
You may be able to make a claim for Universal Credit and ask to be assessed for your capability to work, however, I have heard that the DWP are starting to use previous ESA Decisions to determine whether to assess a claimant under UC.
The criteria for UC is the same as ESA and is detailed in our ESA/UC Claim guides.
